These Terms of Service ("Terms") govern your use of websites and services operated by DS Webhosting Services, including dswebhosting.net.au, Zindle.com.au, and Smokonews.com.au. By using any of these services, you agree to these Terms.
Note: apps published by DS Webhosting (including Director's Cut and Brush Time) are governed by their own separate privacy policies and store terms, not by this document. See the relevant app store listing for those policies.
DS Webhosting Services (ABN 42 988 054 565) is an Australian business providing web hosting, domain registration, server management, and web development services, along with operating Zindle.com.au and Smokonews.com.au. References to "we", "us", or "our" in these Terms refer to DS Webhosting Services.
By accessing or using any website or service operated by DS Webhosting Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services. Continued use of any of our sites or services after changes to these Terms constitutes acceptance of the revised Terms.

Fees for hosting, domain registration, and other paid services are set out at the time of purchase or as agreed in a separate quote or agreement. Payments for services including Zindle.com.au are processed through third-party payment processors, currently Stripe and PayPal. We do not store full payment card details on our own systems — this information is held and processed directly by our payment processors in accordance with their own terms and security standards.
You are responsible for ensuring your payment details remain current and valid for any ongoing or subscription-based services. Failure to maintain valid payment may result in suspension or termination of the relevant service.
Our services may rely on or integrate with third-party providers, including but not limited to TPP Wholesale (domain and hosting infrastructure), Stripe and PayPal (payment processing), and Microsoft (Microsoft 365 reselling). Your use of these integrated third-party services may also be subject to that provider's own terms and conditions. We are not responsible for the acts, omissions, or service levels of third-party providers, though we will make reasonable efforts to assist in resolving issues that arise from their services where they affect you.
All content, branding, logos, and original material published on dswebhosting.net.au, Zindle.com.au, and Smokonews.com.au remain the property of DS Webhosting Services or its respective content owners, unless otherwise stated. You may not reproduce, redistribute, or use this material for commercial purposes without prior written permission.
Content you submit to us (such as account information or content you upload to a service) remains your property, but you grant us a licence to use it as reasonably necessary to provide the relevant service to you.
We make reasonable efforts to keep our services available and operating reliably, but we do not guarantee uninterrupted or error-free operation. Scheduled maintenance, third-party outages, or circumstances outside our reasonable control may result in temporary unavailability of services.
To the extent permitted by Australian law, DS Webhosting Services excludes all liability for any indirect, incidental, or consequential loss arising from your use of our services. Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred on you by the Australian Consumer Law that cannot lawfully be excluded, restricted, or modified.
Where permitted by law, our liability for any loss or damage arising from our services is limited, at our option, to the re-supply of the relevant service or the cost of having the relevant service re-supplied.
You may cease using our services at any time. We may suspend or terminate your access to any service, with or without notice, where we reasonably believe you have breached these Terms, where required by law, or where continued provision of the service is no longer commercially viable for us. Where practical, we will provide reasonable notice before terminating an ongoing paid service.
We may update these Terms from time to time to reflect changes in our services, legal requirements, or business practices. The "Last updated" date at the top of this page reflects the most recent revision. Continued use of our services after changes take effect constitutes your acceptance of the updated Terms.
These Terms are governed by the laws of Victoria, Australia. Any disputes arising from these Terms or your use of our services will be subject to the exclusive jurisdiction of the courts of Victoria, Australia.
